Capstone paper from 2015 spring MPA program. Instructed by Allen Zagoren. We live in a global economy, yet U.S. citizens lag far behind in the knowledge of other countries’ languages, cultures, customs, geographies and peoples. Equipping the next generation with foreign language skills as well as knowledge of other cultures and customs will not only provide increased career opportunities for individuals but also aid in the future success of the U.S. economy. The U.S. educational system does not stress the learning of language beyond English: K-12 curriculum is rigidly mandated, budgets are tight, class time and teacher training is limited, and language programs are often among the first to be cut during budget crises. There is a time period when a child’s brain is developing and most receptive to learning, and that is early childhood. If the seed were planted in a child before he/she enters kindergarten to learn the basics of a foreign language and culture, perhaps that knowledge could be nourished throughout the rest of their lives, preparing those children to embrace cultural differences, live and compete more successfully in an evolving and diverse world, and be better equipped for later education. Besides examining the current state of foreign language education in the U.S. and how learning occurs, the benefits of foreign language learning in relation to business and human relations are examined in this paper. Multiple solutions to solving the foreign language deficit are mentioned including a proposal for an early-learning language program

In lieu of an abstract, below is the essay\u27s first paragraph. A god-awful Springsteen song was playing on the CD jukebox as Harrison Conrad sat drinking his beer. His shoulder-length hair was tied back in a ponytail and a week\u27s worth of stubble had accumulated on his face. His subtle good looks had given way to a look of exhaustion and fatigue. He was scanning the headlines of the newspaper when the door to the bar opened and in walked a slightly graying but youthful-looking man. He sat down at the bar a few feet from Harrison and ordered a drink. Noticing something on the man\u27s face, Harrison politely pointed it out

In lieu of an abstract, below is the essay\u27s first paragraph. 8:04 p.m. I hope she hurries up--we have dinner reservations for 8:30. I think she\u27s coming now. She is, and it\u27s about time. Christ, she looks good--I guess I\u27ll forgive her for taking so long. She\u27s wearing her pearls--she knows that I love them on her. I don\u27t know why, I just do. And that dress. She\u27s wearing the dress. The blue one that drops just enough to show the beginning of the nearly invisible freckles that cover her chest. Not only can I see her coming, I can also smell her coming. It\u27s not just her perfume, though. I mean, of course it\u27s her perfume, but it\u27s also the way that it smells on her. A skunk with perfume on is still a skunk. When my Faith wears this perfume, though, something happens. The aroma comes alive to give an accompaniment to her beauty and caresses the delicate sense known as smell. Most importantly, though, she\u27s wearing the ring. The small gold band that houses two tiny birthstones-- our birthstones. She only wears it on special occasions. I guess she\u27s afraid of ruining it or something. It\u27s the ring I gave her for her college graduation. It\u27s small--you can\u27t get much with a struggling college student\u27s budget- but I honestly believe that she cherishes it as much as, if not more than, her diamond engagement and wedding rings. I pref er it that way actually--the ring is from a time when there was nothing but us and we were too broke for anything but love. Anyway, in all honesty, with the way she looks and the way I feel, I\u27m not sure if we\u27ll make it out the door. We will, though--it took me too damn long to get these dinner reservations

From the Cluetrain to the Panopticon: ISP Activity Characterization and Control of Internet Communications

If ISPs are exposed to liability for forwarding others\u27 messages--messages originating with other ISPs or with the ISP\u27s own users--the norm of universal mutual message forwarding that underlies the present operation of the Internet will be threatened. This Note will argue that society presently confronts a choice between a common carrier Internet characterized by universal mutual message forwarding and a monitored and controlled Internet. Part I will describe the underlying rules that govern ISPs\u27 liability for their users\u27 actions. Part II will argue that the present statutory regime governing ISPs\u27 liability for users\u27 copyright infringement includes elements that provide ISPs with substantial protection for mutual message forwarding and that this regime relies on courts to characterize ISPs\u27 activities to determine which liability standard applies. Part III will argue that courts have characterized one particular networking activity--participating in the Usenet message-forwarding system--inconsistently and that ISPs have not been able to predict the degree to which forwarding Usenet messages exposes them to liability. Part IV will argue that characterizing ISPs\u27 activities so that ISPs are exposed to secondary liability, obliged to comply with section 512(h) subpoenas, and denied section 512(j)(2)\u27s limits on injunctive relief will undercut the norm of universal mutual message forwarding that allows Internet communication and urge courts to characterize ISP activity as transmission or routing protected by the section 512(a) safe harbor to avoid these negative effects
